Before you begin using the Aspireit Application and Website ("App"), you must read and agree to these Terms and Conditions including the Privacy Policy ("Terms") for using this App, which is owned and operated by Siddham Networkit Private Limited (“Company” or "we" or "us" or "our” or “Aspireit”). By using this App, you (including the legal guardian/parent of a minor) ("you" or "user") agree to and shall abide by all of the Terms set forth below which shall be binding on you. By accessing the App or any part thereof, you are explicitly agreeing to the Terms.

Although we may attempt to notify you when major changes are made to these Terms, you should periodically review the most up-to-date version. We may, in our sole discretion, modify or revise these Terms and policies at any time, and you agree to be bound by such modifications or revisions. In the event you do not agree to any of the Terms mentioned herein, we advise you to stop using this App.

The Company allows you to access the App and all contents provided on this App including all information, software, graphics, function, and other materials are subject to the terms and conditions outlined below. By accessing or using the App or any part thereof, you are explicitly agreeing to the terms and conditions below. The Company reserves all rights to change, modify, update, or alter these Terms at any point of time with or without notifying you. Your continued use of the App means that you accept any updated terms and conditions that we come up with. If you do not wish to accept any update to these Terms and Conditions, then you shall immediately stop accessing and/or using the App. Please re-visit the Terms and Conditions at our App from time to time to stay abreast of any changes that we may introduce.

INTRODUCTION TO THE APP

The ‘Aspireit’ is a community of career-centric youth and the App enables this community of youth to avail its benefits. This could be in the form of special access to jobs, career-centric networking, career projects, upskilling videos and much more.

SCOPE

Your use of the App is governed by these Terms, except to the extent that certain terms are the subject of a separate agreement. Specific terms or agreements may apply to the use of certain services and other items provided to you via the App (“Services”). Any such agreements will accompany the applicable services or are listed in association therewith or via a hyperlink associated therewith (“User Agreement”).

The use of our App is also governed by our Privacy Policy and the User Agreement. The Privacy Policy covers the use of cookies. The Privacy Policy is incorporated into these Terms and Conditions by reference.

Access to the App is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason the App is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the App. Your use of a App after any amendment to the Terms of Use shall constitute your acceptance of these terms and you also agree to be bound by any such changes/revisions.

USER ELIGIBILITY

Our Service is intended for users aged 18 and above. We do not knowingly collect personal information from individuals under the age of 18. If you are a parent or guardian and discover that your child has provided personal data to us, please contact us immediately. If we find that we have inadvertently collected personal data from someone under 18 without parental consent, we will take prompt steps to remove that information from our records.

In situations where we rely on consent as the legal basis for processing your information, and if your country mandates parental consent for minors, we may require consent from your parent before proceeding with collecting and using your information.

We retain the right to grant or deny access to the App and its services if it comes to our attention that you are under 18 years of age without proper parental or guardian consent, or if any information provided by you is found to be inaccurate.

You acknowledge that it is your responsibility to ensure that you meet the eligibility criteria mentioned above, except for undergoing the necessary verification process. If you do not meet these qualifications, you are not permitted to use the App.

ACCOUNT SECURITY

When you create an account on the App you register yourself as a member ("Member") to access certain Services as per the Terms and provide us with personal data and sensitive personal data. You shall be solely responsible for keeping your account and be responsible for all the transactions and activity on your account. We assume no liability for any loss or consequences caused by authorized or unauthorized use of your account credentials, including but not limited to information disclosure, information release, consent, or third-party links, or because of any disclosure made by you. You agree to strictly abide by all our mechanisms and procedures regarding security, authentication, sending, receiving, and withdrawing.

INTELLECTUAL PROPERTY

All the content and information provided on the App in any form and capable of being stored on a computer or mobile device that appears on, or forms part of, including any trademarks, information related to any Services, contact details, graphics, functions and other materials available, whether publicly posted or privately transmitted as well as all derivative works thereof; including the App's design structure and compilation and all content such as text, images, audio, video, scripts, code, documents, databases, all types of learning tools, facts, the mascot and the source code managed and operated by the Company and/or any youth participating or organizing an Activity in their respective institution ("Content"), belongs to the Company or its content partners or licensors.

The Company shall not be liable for any Content posted by a youth which does not conform with the templates provided by the Company to such youth to operate any account on social media using their logos.

The Company or its partners/licensors own all intellectual property rights (including copyright and database rights) in the Content. You agree to abide by the copyright law and all other applicable laws of India and acknowledge that the App and the Content in source code form remains a confidential trade secret of the Company, therefore, you agree not to modify the App and/or Content or attempt to decipher, decompile, disassemble or reverse engineer the App and/or the Content, except to the extent applicable laws specifically prohibit such restriction.

You may retrieve and view the Content on a computer screen, PDA or mobile telephone, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk or your computer (but not on any server or other storage device connected to a network) for your personal, non-commercial use only.

You shall not use the App for any unlawful purpose.

Except as indicated above, you shall not reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive or in any way commercially exploit any of the Content. Without limitation, you shall not do any of the following without prior written permission from us (and neither shall you allow a third party to do any of the same):

Infringing upon the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or any other proprietary rights. For instance, you may not copy or distribute the posts or content of other users of the App.

Infringing upon the intellectual property or other rights of the Company, including but not limited to (i) copying or distributing our content or (ii) using our technology without permission, unless it is released under open-source licenses; (iii) using our trademarks, tradenames, logos, or associated trademarks in any business name, email, URL, or on social media platforms without prior consent from the Company.

Creating a database by systematically downloading and storing any of the content.

Deep-linking to, framing, spidering, harvesting, scraping, or otherwise copying profiles and other data from the content for similar purposes.

Using any machine, electronic, web-based, or similar device to read or extract the content through automated techniques.

Using the content in a searchable, machine-readable database.

Violating any guidelines and regulations applicable to your jurisdiction while monetizing your content.

Acting on behalf of any third party or acting as an intermediary between the App/Company and any third parties.

Defaming, abusing, harassing, stalking, threatening, or otherwise violating the legal rights of others.

Publishing, posting, uploading, distributing, or disseminating any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topics, names, materials, or information.

Uploading files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents.

Uploading or distributing files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the App or another user's computer.

Violating any applicable laws or regulations in force in or outside India.

Violating any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.

The App as well as the Content is the valuable, exclusive property of the Company, and nothing therein shall be construed as transferring or assigning any such ownership rights to you or any other person or entity. All Content is the proprietary, confidential property of the App and cannot be repeated for any reason outside the App, without our prior consent. You agree not to repeat or rebroadcast in any way any of the Content for any reason whatsoever. You agree that if you do repeat or re-post any of the Content by any means, you will be exclusively liable under criminal law and shall also be liable for actual and punitive damages as determined by the Company and additional damages to be determined by a court of law.

You are not permitted to rent, lease, sublicense, distribute, transfer, copy, reproduce, publicly display, publish, adapt, store, monetize, or time-share the App, any part of it, or any of the content and related data received or accessed from it to any other individual or entity unless you have obtained separate and explicit written authorization from the Company beforehand. Additionally, you are prohibited from removing, altering, or obscuring any copyright, legal, or proprietary notices in or on any parts of the App without prior written authorization.

RESTRICTIONS AND PERMISSIONS ON USE

In addition to other restrictions set forth in these Terms, you agree that:

You will abide by the Community Guidelines without exception.

You will refrain from posting false or deceptive information on the App.

You will use or access any service, information, application, or software available via the App only as explicitly permitted by us.

You will avoid hosting, displaying, uploading, modifying, publishing, transmitting, storing, updating, or sharing any information that belongs to another person without proper authorization.

You shall not conceal the origin of transmitted information through the App or disclose any information without consent.

You will refrain from uploading any information containing viruses, Trojan horses, worms, or other harmful computer programming routines, or infringing on the intellectual property rights of others.

You will not copy, use, disclose, or distribute any information obtained from the Content without the Company's consent.

You will not claim or imply affiliation with or endorsement by the Company without explicit consent.

You will avoid using bots or automated methods to access or manipulate the Content.

You will not monitor the Content for competitive purposes or engage in actions that simulate or replicate the Content's appearance or function.

You will comply with all applicable laws regarding your use of the App and its Content.

You will utilize the Content in a professional and responsible manner.

Furthermore, you expressly undertake not to host, display, upload, modify, publish, transmit, update, or share any information that is harmful, harassing, defamatory, obscene, pornographic, libelous, invasive of privacy, hateful, racially or ethnically objectionable, encouraging illegal activities, or otherwise unlawful.

You shall not harm minors or impersonate another person.

You shall not threaten national unity, integrity, security, or sovereignty, or incite criminal offenses.

You will not infringe upon any patent, trademark, copyright, or other proprietary rights.

You will avoid deceiving or misleading by falsifying the origin of the message or knowingly communicating false or misleading information.

You shall not aim to mislead, harass, or cause harm for financial gain or to any individual, entity, or agency.

These guidelines are to be strictly adhered to during your usage of the App and its Content.

THIRD PARTY SERVICES

The Company allows You to create an account and log in to use the Service through the following Third-party Social Media Services: Google

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may choose to share additional information with the Company through Your Third-Party Social Media Service's account. Should You opt to provide such information and Personal Data, whether during registration or otherwise, You are granting the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

It is acknowledged that the App will facilitate or assist you in accessing, interacting with, and potentially purchasing products and services from various supported platforms, brands, and other third parties via links to third-party websites or applications (collectively referred to as “Third-Party Services”). These Third-Party Services operate independently from the Company.

The Company neither reviews, approves, monitors, endorses, warrants, nor makes any representations with respect to Third-Party Services and bears no responsibility for them. Users engage with Third-Party Services at their own risk and should exercise caution and discretion accordingly.

Any use of Third-Party Services is governed solely by the terms and conditions established by those services. Any contracts entered into or transactions completed via Third-Party Services are exclusively between the user and the relevant third party.

Users must comply with all applicable terms of Third-Party Services they access or subscribe to. If, at any point, Third-Party Services cease to make their programs available to the Company on reasonable terms, the Company may discontinue providing such features to users without entitlement to refund, credit, or other compensation.

Additionally, users' interactions with promotions and deals from advertisers and partnered brands found on the App, including payment and delivery of goods and services, are solely between the user and those advertisers and partnered brands. The Company will not be held responsible for any loss or damage resulting from users' dealings with such advertisers and partnered brands.

CONTENT REVIEW

You acknowledge that, to ensure compliance with legal obligations and the Terms, the Company may need to review certain User-generated Content submitted by you to the App. This review may occur at two levels: first, automatically by our content filtering mechanism, which can flag text content submitted by you if it violates any of the terms and conditions of this App or any applicable laws; and second, by the actions of other users who may report such content to our content moderation team. Our content moderation team then takes appropriate action in accordance with the content regulation policy followed by them. When our content filtering mechanism detects or flags any User-generated Content, our content moderator may modify, prevent access to, delete, or refuse to display such content that we believe violates the applicable laws or these terms and conditions.

Content Removal, Limitation, Suspension, and Termination of user account

We reserve the right to remove any Content or information you share on the App or community (“User Generated Content”) if we believe it violates these Terms or when permitted by applicable law. In certain situations, we may need to limit, suspend, or terminate your account. Account limitation entails a temporary or permanent loss of access to specific parts of the Services, while account suspension results in a temporary loss of access to most parts of the Services. Account termination leads to a permanent loss of access to all Services. As a consequence of limitation, suspension, or termination, at our discretion, we may restrict your entitlement to receive the Award Amount.

We may also remove any User Generated Content when:

• We receive a report from another user regarding your use of the App or your activity on the Application being malicious, abusive, harmful, offensive, or violative of these terms and conditions in any manner;

• We have the right to limit, suspend, or terminate your account or access to the Services if:

• We believe you have violated these Terms or applicable laws or regulations, or if any content or material submitted or shared by you violates these Terms or applicable laws or regulations or third-party rights;

• We suspect you are engaging in fraudulent activity, money laundering, terrorist financing, or other crimes;

• We cannot verify your identity, or we believe you have provided false, misleading, or deceptive information;

• We are legally required to do so by any applicable law, regulation, or court order;

• We receive a report from another user regarding your use of the App or your activity on the App being malicious, abusive, harmful, offensive, or violative of these terms and conditions in any manner, which may lead to the limitation or termination of your access to the App, without any right of appeal;

• You engage in behavior that defames, invades privacy, stalks, is obscene, pornographic, racist, abusive, harassing, threatening, or offensive;

• You use the services in a manner that interrupts or damages the Services' functionality or attempts to bypass or break any security mechanism of the Services;

• You attempt unauthorized access to user accounts or any part of the Service

PRIVACY POLICY

Our App is dedicated to simplifying holistic learning and offering a trusted career development and growth platform for youth. By visiting or accessing this App and its Content, you agree to abide by the terms and conditions outlined in this privacy policy (“Privacy Policy”). This Privacy Policy elucidates how we collect, store, utilize, and share personal data and digital personal data. If you do not consent to these terms, please refrain from using or accessing our App.

By simply using the App, you explicitly consent to our utilization and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is an integral part of and is subject to the Terms.

In our commitment to safeguarding your privacy, the Company and this Privacy Policy comply with the Digital Personal Data Protection Act, 2023 and its regulations (“Data Laws”), including any subsequent amendments.

TYPES OF INFORMATION WE COLLECT

We will process personal data under the basis that it is necessary to perform the contract you enter with us. Additionally,

we will process personal data based on our legitimate interests following your registration.

We may collect two types of information, namely 'Submitted Information' and 'Aggregate Information' (referred to collectively as "Data").

(A) Submitted Information - Information provided by you and collected from you, including personal data and sensitive personal data:

• Account Information: When you register as a Member, you furnish us with data such as your username, full name, email address, and password (if provided). You may also be required to upload your profile picture.

• Communication Information: Our App includes Communication Facilities such as messages/bulletin boards, forums, marketplace, community feed, chat rooms, audio files, video chats, voice chats, and posts. We collect information when you send, receive, or engage with messages, or use our Communication Facilities.

• Other: We may request information when you report an issue with the App. Correspondences with us may be recorded. Telephone recordings or transcripts may be used for various purposes such as analyzing and improving our Services, training, and quality assessment. Information regarding your location and movements may be stored for the App's functionality and monitoring. We may also retain details of your visits to the App, including traffic and location data, weblogs, and other communication data.

(B) Aggregate Information - Information collected about you and your device:

Each time you use our App or access the Services, we may automatically collect technical information, such as device type, IP address, unique device identifier, mobile network information, operating system, and browser type. We may also collect usage data when you interact with our App or Content, including clicks on content, advertisements, searches, article shares, or project applications. Log-ins, cookies, device information, and IP addresses may be utilized to identify you and log your usage.

Please refrain from adding or submitting any Data on the App if you do not wish for it to be collected.

WHAT WE DO WITH THE INFORMATION

Any portion of the Data containing personal data of minors (individuals below 18 years of age) provided by you is considered to be given with the consent of the minor's parent or legal guardian. Such consent is presumed to be granted by your registration with us. We prioritize the privacy of minors and urge parents/guardians to accept this Privacy Policy on behalf of minors to supervise the types of data shared with us. To ensure the safety of data shared by minors, we may periodically integrate new mechanisms and safeguards on our App.

Submitted Information:

We utilize Submitted Information to provide and personalize the Services, authenticate your access, enhance the quality of Content provided on the App, personalize your online experience, and foster a strong student community. Accurate information provided by you enables us to analyze usage patterns and enhance the offerings and experiences provided to you.

We use the Data for the following purposes to facilitate the Services:

• Provide all App offerings and features;

• Communicate with you, including updates to the App, Aspireit App, and the Terms, including this Privacy Policy;

• Conduct market and customer research;

• Market our Services to you;

• Address errors and problems with the App and its features;

• Investigate and prevent suspected fraud or other criminal activities.

Selected Data may be shared with other users of the App as part of the Services to enhance their experience. Additionally, we may share Data with third-party service providers associated with us. However, you are advised to review the terms of use and privacy policy of such third parties. You are required to adhere to their terms, and we disclaim responsibility for them.

We do not share your Data with third-party advertisers or ad networks except for (i) hashed IDs or device identifiers (to the extent they are personal data in some countries); (ii) with your separate permission, or (iii) your profile information already visible to users of the Services.

DISCLOSURE OF INFORMATION

We may disclose your Data to (i) the Company's current and future entertainment, sponsorship, advertisement, and development partners, as well as strategic alliances and (ii) the Company's contractors, vendors, consultants, users, Members, and professional advisors to the extent necessary for them to perform services on our behalf, and only under disclosure restrictions.

While it is our policy to respect the privacy of our Members, including information about their use of the Services, such as the contents of messages, posts, and other Content, we reserve the right to monitor, edit, or disclose any Data about the Member, their use of the Services, or email contents in certain circumstances to (i) conform to legal requirements, comply with legal processes, or assist government enforcement agencies; (ii) to protect and defend the Company's rights; (iii) to enforce any agreement you have with the Company; (iv) to protect the interests of stakeholders and others; (v) to investigate and defend against any third-party claims or allegations; (vi) to protect the security or integrity of our App; (vii) to exercise or protect the rights and safety of our users, personnel, or others.

Any portion of the Data containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor's parent or legal guardian. Such consent is presumed to be provided by your registration with us.

Additionally, we may transfer your Data as part of the assets of the Company if the Company or parts of its business are sold to, merged with, or acquired by a third party. The Data collected by us may be stored and processed in India or any other country in which the Company or its agents/affiliates maintain facilities. By using the Services, you consent to any such transfer of information outside of your country.

LEGAL BASIS FOR USING THIS INFORMATION

We have appropriate legal bases for collecting, using, and sharing Data about you, which may include consent (where you have provided consent) and contract (where processing is necessary for the performance of a contract with you, such as delivering our core services to you).

(A) Performance of a contract:

We require Data from you to:

• Provide access to the App;

• Deliver the Services to you;

• Ensure the security of our App for all users;

• Analyze Members' behavior, preferences, and device information to enhance the Services and user experience on our App.

(B) Consent:

We will always seek your consent to process certain types of Submitted Information where legally required. If we rely on your consent, you have the right to withdraw or decline it at any time. Withdrawal will not affect the lawfulness of processing your Submitted Information prior to withdrawal. Changes in consent will not apply retrospectively and will be implemented prospectively by us.

YOUR RIGHTS IN RESPECT OF THE DATA

You can obtain the following information by submitting a written request to support@aspireit.net.in:

• A summary of the personal data processed by us, and the processing activities undertaken by us with respect to the personal data.

• Identities of all our affiliates or representatives with whom the personal data has been shared by us, along with a description of the personal data so shared.

We store your Data with our backend team and will provide it to you upon your written request as outlined above. However, we may choose not to share the above information with you if your personal data has been shared with another person/entity/authority authorized by law to obtain such personal data, where such sharing is pursuant to a written request made by such an authority for the purposes of prevention, detection, or investigation of offenses or cyber incidents, or for prosecution or punishment of offenses.

If you find any personal data to be inaccurate, misleading, or incomplete, we will rectify, update, or complete the personal data at your specific request. We are not responsible for the authenticity and correctness of the information supplied by you.

Option to opt out: Prior to the collection of your personal data, we have provided you with an option to not provide the personal data. Even after collection, if you wish to withdraw your earlier consent, upon a written withdrawal of consent submitted by you, we will accept the same. If you choose to withdraw your consent or request the erasure of personal data, we will, within a reasonable time, erase or cease processing the personal data, unless retention is necessary for a specified purpose or for compliance with any applicable law. If you decide not to provide the personal data or withdraw your consent after providing it, we reserve the right not to provide the services for which the information was sought. The consequences of opting out or withdrawal shall be borne by you, and such withdrawal shall not affect the legality of processing of the personal data based on consent before its withdrawal.

You may nominate any representative on your behalf to exercise your rights under this Privacy Policy in the event of your death or incapacity.

If you have any grievances regarding your rights or obligations under this Privacy Policy, you may write to the Grievance Officer designated by us. Upon receipt of any discrepancies or grievances, we will strive to resolve them in a time-bound manner as per the Data Laws. YOUR DUTIES UNDER THE DATA LAWS

While exercising rights under the provisions of the Data Laws:

• You must comply with all applicable laws currently in force.

• You must not impersonate another person when providing your personal data for a specific purpose.

• You must not withhold any material information when providing your personal data for any document, unique identifier, proof of identity, or proof of address issued by the State or any of its instrumentalities.

• You must not file a false or frivolous grievance or complaint with us, our Grievance Officer, or any authority established under the Data Laws.

• You must always provide only verifiably authentic information when exercising the right to correction or erasure under the provisions of the Data Laws.

Your Aspireit account information is password-protected for your privacy and security.

COOKIES

Our App uses 'cookies' to collect data to recognize you and your devices and the devices where you have accessed the Services. Cookies are small file of letters and numbers that we put on your device when you use the App. We use cookies to improve the quality of our Services by storing user preferences and tracking user trends, such as how people search. The information collected through cookies is not sold, rented or shared with any third parties except for event analytics service company that tracks user interactions with web and mobile applications. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and Services may not function properly if your cookies are disabled. We shall use both persistent cookies which could remain on your device until their expiry (which, in some cases, upto 10 years) and session cookies, which are temporary files removed from your device once your browser is closed. We may use the analytical/tracking cookies which allows us to recognise and count the number of visitors and analyse use of the Services, as well as to verify transactions.

DELETING INFORMATION ABOUT YOU

If you wish to delete your account, please send an email to us at support@aspireit.net.in from your registered email address.

HOW LONG WE KEEP YOUR INFORMATION

We generally retain your personal data as long as you keep your account open or as needed to provide you Services and for a period of 5 (five) years after you have requested that your account is closed or if it’s been inactive for 5 (five) years. This includes data you or others provided to us and data generated or inferred from your use of our Services.

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in future.

Where we process personal data in connection with performing a contract or for a competition, we keep the data for 6 (six) years from your last interaction with us.

VIOLATIONS

You acknowledge that failure to comply with the obligations outlined above, as well as the rules, regulations, terms, conditions, agreements, and Terms applicable to the access and usage of the App, grants the Company the right to immediately terminate the access or usage rights of users to the App and remove non-compliant information.

Furthermore, the Company shall not host, store, or publish any unlawful information which is prohibited under any law currently in force. This includes but is not limited to content that pertains to:

• The interest of the sovereignty and integrity of India;

• Security of the state;

• Friendly relations with foreign states;

Any violation of these Terms may result in civil or criminal liability. In addition to any legal remedies available, the Company reserves the right to immediately terminate permission for any user or, if necessary, for all users to use the App. The Company also reserves the right to terminate or remove material, information, messages, or communications that, in its sole discretion, may be illegal or subject the Company to liability or violate these Terms.

The Company may conduct investigations into any suspected or alleged violation of these Terms and cooperate with law enforcement authorities and/or third parties in such investigations.

If a User has a grievance regarding the serious nature of content, information, posts, or messages posted on the App, they must promptly inform the Company by providing complete details of the violation. Upon receiving such a complaint, the Company shall forward it to the Grievance Redressal Officer (GRO), whose contact information is provided in the Privacy Policy and the Terms. The GRO will acknowledge receipt of the complaint within 24 hours and resolve it within 15 days of receipt.

We do not guarantee the updating or continuity of such information on the App, nor are we responsible for any errors in the information obtained from third-party sources or for any unavailability of such information. To the extent permitted by applicable law and to the extent that the Company is found responsible for damages, we shall be liable for actual damages only. Under no circumstances shall the Company, its affiliates, licensors, suppliers, or any third parties mentioned on the App be liable for incidental, indirect, exemplary, punitive, and/or consequential damages, including lost profits or damages resulting from lost data or business interruption, arising from the use or inability to use the App or the Content. This applies regardless of whether the claim is based on warranty, contract, tort, or any other legal theory, and regardless of whether the Company is aware of the possibility of such damages. You agree not to take any action that might cause the Company to violate any applicable laws, regulations, or rulings.

The Company and the App are headquartered in the Republic of India. The Republic of India and certain other jurisdictions regulate the export of products and information provided on this App. You agree to adhere to all such applicable restrictions and not to export or re-export the Content (including any software or services) to countries or individuals prohibited under the laws of the Republic of India or other applicable export control laws or regulations. By accessing and downloading the Content (including any software or services), you confirm that you are not in a country where such export is prohibited, or you are not a person or entity to which such export is prohibited. You are solely responsible for complying with the laws of your local jurisdiction and any other applicable laws regarding the import, export, or re-export of the Content (including any software or services).

INDEMNIFICATION

GOVERNING LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of India. You explicitly agree that irrespective of the country you are a citizen/resident of and whether or not you are a resident of the Republic of India, you shall be bound by the laws and regulations relating to data protection of the Republic of India. You explicitly agree that only courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any disputes arising hereunder.
